uplistd ("we", "us", or "our") provides the uplistd website, dashboard, public listing pages, and related services (the "Service"). We are based in Ontario, Canada and make the Service available to users in Canada and the United States. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use the Service.

1. Information we collect
We may collect the following types of information:
- Account information: name, email address, phone number, account settings, authentication details, and login activity.
- Listing content: property details, photos, descriptions, branding, documents, domain settings, and other media or content you upload or publish.
- Lead and inquiry information: information submitted through contact forms or other inquiry tools on public listing pages, such as name, contact details, and message content.
- Billing information: subscription status, plan details, transaction records, and payment information processed by Stripe. We do not store full payment card numbers.
- Usage and device data: log data, pages viewed, feature usage, browser and device information, IP address, approximate location derived from IP address, referral URLs, and product activity.
- Communications: support requests, feedback, survey responses, and messages you send to us.
- Cookies and similar technologies: information used for essential functionality, authentication, security, analytics, and performance.
2. Public listing pages and lead forms
Listing content you choose to publish on a public listing page may be visible to anyone on the internet and may be indexed by search engines or shared by visitors.
Lead form submissions are private. For lead submissions, uplistd acts as a service provider to the listing owner, agent, brokerage, or account owner who receives the inquiry. We make those submissions available to the relevant account owner, authorized users, and the service providers needed to operate the Service and deliver the inquiry. The listing owner or account owner is responsible for how they respond to and otherwise use lead information outside the Service.
3. How we use information
We use personal information to:
- Provide, operate, secure, and maintain the Service
- Create, host, publish, and manage listing pages and related features
- Process payments, subscriptions, billing, and account administration
- Send service notices, security alerts, billing notices, and support responses
- Route leads and inquiries to account owners and authorized users
- Monitor usage, diagnose issues, measure performance, and improve the Service
- Protect against fraud, abuse, spam, unauthorized access, and other harmful activity
- Comply with legal obligations and enforce our terms and policies
4. Legal bases and consent
Where required by law, we process personal information based on consent, performance of a contract, legitimate business interests, and compliance with legal obligations. In Canada, we collect, use, and disclose personal information with consent where required, including implied consent where appropriate for providing and improving the Service. You may withdraw consent where we rely on consent, subject to legal or contractual restrictions.
5. How we share information
We may share information with:
- Service providers: vendors that support hosting, storage, authentication, payments, analytics, email delivery, domain services, customer support, security, and monitoring. These may include AWS, Amazon Cognito, Amazon S3, Amazon SES, Stripe, and Google Analytics.
- Account owners and authorized users: information connected to their account, listings, leads, domains, subscription, and team members.
- Public listing visitors: content you intentionally publish to a public listing page.
- Business transfers: in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets.
- Legal and safety: when required to comply with law, legal process, or requests from public authorities, or to protect rights, safety, security, and the integrity of the Service.
- At your direction: when you ask us to share information or connect a third-party service.
We do not sell personal information or use it for cross-context behavioral advertising.
6. Cookies and analytics
We use essential cookies and similar technologies to keep the Service working, including for authentication, security, session management, and account access. We also use analytics and performance technologies, including Google Analytics, to understand how the Service is used and to improve performance and product experience.
We do not currently offer a separate cookie consent tool. You can control cookies through your browser settings, but some features may not function properly if essential cookies are disabled. You can also use the Google Analytics opt-out browser add-on.
7. Data retention
We keep personal information only as long as reasonably necessary for the purposes described in this Policy, including to provide the Service, operate accounts and listing pages, route leads, comply with legal, tax, and accounting obligations, resolve disputes, enforce agreements, prevent fraud and abuse, maintain security, and preserve backups. Retention periods vary based on the type of information, the sensitivity of the information, the reason we collected it, and applicable legal or operational requirements.
If you delete content or close an account, copies may remain for a limited period in backups, logs, or records we maintain for legitimate business, legal, security, or compliance purposes.
8. Your rights and choices
Depending on your location, you may have the right to access, correct, delete, or export your personal information, and to object to or restrict certain processing. You may also withdraw consent where we rely on consent.
If you are a resident of a U.S. state with an applicable privacy law, you may have additional rights, such as the right to know what personal information we collect, use, disclose, or share; the right to request deletion or correction; the right to data portability; and the right to appeal certain decisions. We do not sell personal information or use it for cross-context behavioral advertising.
To make a request, email hello@uplistd.com. We may need to verify your identity before completing your request. If your information was submitted through a listing lead form, we may direct your request to the relevant listing owner or account owner when they are responsible for the information.
9. International transfers
Your information may be processed in countries other than where you live, including Canada and the United States. These countries may have data protection laws that differ from the laws in your jurisdiction. Where required, we use appropriate safeguards for cross-border transfers.
10. Security
We use reasonable administrative, technical, and organizational measures to protect personal information. No method of transmission or storage is completely secure, so we cannot promise absolute security.
11. Children’s privacy
The Service is not intended for children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us and we will take appropriate steps to remove it.
12. Changes to this policy
We may update this Privacy Policy from time to time. If we make material changes, we will post the updated version here, update the Last updated date above, and provide additional notice when appropriate, such as by email, in-product notice, or another reasonable method.
